Please, read this Terms of Service (“TOS”, “Terms”) carefully before using any app (“Service”) powered by BMSOFT LLC (“we”, “our”, “us”, “BMSOFT”).

By using our Service, you agree to this TOS. If you disagree with any of these Terms, do not use our Service. ​

If you will be using the Service on behalf of an organization, you agree to these Terms on behalf of that organization and you represent that you have the authority to do so. In this TOS, “you” and “your” will refer to you and the organization you represent.

Privacy

When using the Service, you may submit your personal data and the personal data of other persons you represent to BMSOFT or your website users, visitors (“others”) may submit their personal data to you through our Service (all of the above mentioned data will be referred to as “Data”).

No means of transmission of Data over the Internet is 100% safe, but we guarantee, that all the Data transmitted when using our Service is not used, sold or shared from our side.

Security

All our connections are secure and protected with a verified SSL certificate(HTTPS). All the Data is properly encrypted with a private key before being sent and saved, under no circumstances can it be deciphered by others.

Confidentiality

Your IP, personal information and received Data are confidential and we will not access them unless there are obligatory circumstances, such as per your request or required by law. When required by law we will use commercially reasonable efforts to notify you before the disclosure.

Confidential Information shall not include information which becomes public without any breach of this Terms.

Your Responsibilities

You are responsible for controlling your Data and communications with others while using the Service.

You agree not to use the Service to violate any local, state, national, or international law or regulation.

Log Data

Like many apps, we collect information that the browser sends.

This Log Data may include information such as computer's Internet Protocol ("IP") address, browser type, browser version, the date of submission, etc.

This Data is collected to form the charts and statistics of your entries and is exclusively available for you. ​

Antispam policy

We secure your form from unauthorized access. To fight against spam, we also embedded 3rd party components to your website, which are not available to robots. We have also strong security and algorithm to identify spammers and blacklist them.

Communications

We may use your email address registered on our Service for sending you notification emails, newsletters or informing about our new updates.

Payments, Pricing and Refunds

You agree to pay to any fees for each Service you purchase or use (including any overage fees). If you have elected to pay the fees by credit card, you represent and warrant that the credit card information you provide is correct and you will promptly notify us of any changes to such information.

Paid accounts are Subscriptions. Your Subscription will automatically renew at the end of each billing cycle unless you cancel it yourself or contact our customer support team regarding the cancellation.

We may change the fees charged for the Service at any time, provided that, for Service billed on a subscription basis, the change will become effective only at the end of the then-current billing cycle of your Subscription. We will provide you with reasonable prior written notice of any change in fees to give you an opportunity to cancel your Subscription before the change becomes effective.

​ You are responsible for carefully reviewing the Subscription plans and specific conditions related to particular plan before subscribing. Fees paid by you are non-refundable, except in the case of billing errors caused by BMSOFT or when required by law.

Cancellation of Services

Cancelation of Subscription may cause the loss of some features of the Service and the deletion of some Data you’ve collected through use of the Service. To the extent permitted by applicable law, we do not accept any liability for such losses.

If you have cancelled your Subscription, you still can use Service until the end of your then current Subscription end date.

GDPR Compliance

The EU’s new data privacy regulation, the GDPR (General Data Protection Regulation) took effect on May 25th 2018. All entities that collect or process data of EU citizens should comply with GDPR. ​

BMSOFT has done some thorough check-ups on its system to make sure its level of data security complies with the GDPR requirements.

*You must complete the highlighted information and the signature box, sign on the Page 4 and send the completed and signed Agreement to '[email protected]'.We will sign the Agreement and will send it back to you.

Warranty

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR PARTNERS, BE LIABLE TO YOU FOR ANY LOSS OF PROFITS, USE, OR DATA, OR FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES RESULTING FROM YOUR USE OF THE SERVICE.

Limitation of Liability

SERVICE IS PROVIDED ON AN "AS IS" AND WITHOUT ANY WARRANTY. WE HEREBY DISCLAIM ANY AND ALL WARRANTY NOT EXPRESSLY PROVIDED HEREIN, INCLUDED BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE. WE MAKE NO WARRANTY OR REPRESENTATION THAT OUR SERVICE WILL MEET YOUR REQUIREMENTS OR OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS RESULTING FROM YOUR DOWNLOADING AND/OR USE OF FILES, INFORMATION, CONTENT OR OTHER MATERIAL OBTAINED FROM THE SERVICE.

Changes to This TOS

We reserve the right to update or change our TOS at any time and you should check this page periodically. Your continued use of the Service after we post any modifications to the Terms on this page will constitute your agreement of the modifications and your consent to abide and be bound by the modified Terms.

If we make any material changes to this TOS, we will notify you either through the email address you have provided us, or by placing a prominent notice on our website.
